Welcome to SwingFitAI. By accessing or using our website, AI Club Recommendation Engine, Fitter Portal, or iOS Video Motion Capture App (collectively, the "Services"), you agree to be bound by these Terms of Service.

1. Description of Services

SwingFitAI provides an AI-powered custom golf club fitting augmentation platform. The Services capture motion and perform biomechanical scaling via our secure APIs. The outcomes presented by the algorithm are designed to supplement—not replace—professional golf club fitters. We do not manufacture or sell physical golf clubs.

2. Intellectual Property & Patents

All technology, interfaces, and algorithms underlying the Services are the exclusive property of SwingFit Inc. Our processes and mechanical pipelines are protected under international intellectual property law, notably citing:

• U.S. Patent No. US20240293698A1

You may not copy, reverse engineer, or commercially exploit any part of our "Swing Signature" generation API, recommendation physics, or product catalog without explicit written authorization.

3. Prohibited Conduct

Users, fitters, and third-party developers agree they will not:

• Scrape, datamine, or mechanically extract the club catalog sizing data or algorithmic outcomes.
• Attempt to reverse-engineer the proprietary 1-5 polynomial rating system or matching algorithm.
• Submit mock data strictly intended to map or exploit the logic of the platform.

4. Hardware and Capture Recommendations

Successful data extraction within the iOS Video Application requires high fidelity video capture. Users are responsible for providing sufficient lighting (lux > 50) and utilizing devices capable of securely capturing 1080p video at high frame rates (120FPS to 240FPS). SwingFitAI is not responsible for failed analysis caused by inadequate hardware or environmental settings.

5. Disclaimer of Warranties; Limitation of Liability

The Services are provided "as is" and "as available". SwingFitAI makes no expressed guarantees that utilizing recommended club hardware will result in lower scores or physical improvement.

Under no circumstance shall SwingFit Inc. be held liable for any direct, indirect, incidental, or physical damages, including bodily injury sustained while utilizing custom clubs generated by this service or interacting with the recording software during a live golf swing.

6. User Accounts & Responsibilities

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during the registration process and to continually update such information.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

8. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide reasonable notice for any substantial material changes. Your continued use of the Services following the posting of any changes constitutes acceptance of those changes.
